The article examines the essence of property rights, the characteristics of things capable of serving as objects of real rights, and the legal classification of digital and other intangible assets. It distinguishes individually determined things from fungible things and explains when fungible assets may become objects of ownership through factual separation. Using certificated and uncertificated securities, crypto-assets and entries in distributed ledgers as examples, the article differentiates ownership of a tangible thing from a property right in an intangible object. It argues that a crypto-asset should be classified not as a thing but as a property right with value and an identifiable holder, recorded through digital entries.
